Terms of Service

These terms apply when you use ChauffeurHQ. Please read them together with our Privacy Policy.

1. About these terms

ChauffeurHQ is provided by Beewest IT Consultancy Pty Ltd (ABN 31 616 435 468), Perth, Western Australia ("Beewest", "we", "us"). These terms cover:

Together these are "ChauffeurHQ". By creating an account or using ChauffeurHQ, you agree to these terms. If you don't agree, please don't use ChauffeurHQ.

2. Our role and the operator's role

ChauffeurHQ is software that chauffeur and limousine companies ("operators") use to take bookings, dispatch drivers and run their business.

  • Beewest provides the software. We are not a transport provider. We don't provide chauffeur services, employ or engage drivers, or own vehicles.
  • The operator provides your trip. When you book through ChauffeurHQ, your booking is an agreement between you and that operator. The operator sets its own prices, payment terms, cancellation policy and conditions of carriage, and is responsible for its drivers, vehicles, licences and insurance.
  • Questions or complaints about a trip, a fare or a driver should go to the operator first. We're happy to help put you in touch.

3. Your account

  • You must be at least 16 to create an account. A parent or guardian may book trips for a child.
  • Give accurate details and keep them up to date. You can sign in with email and password, Google or Apple.
  • Keep your sign-in details secure, and don't share your account. You're responsible for activity on your account. Tell us straight away if you think someone else has used it.
  • One account works across all ChauffeurHQ apps and websites. What you can do depends on the role an operator gives you: passenger, driver, manager or administrator.
  • You can delete your account at any time in the app under Account → Delete account, or by emailing us. See Deleting your account.

4. Passengers

  • A booking request is only confirmed once the operator accepts it. Times, prices and vehicle types are set by the operator.
  • Give correct pickup, drop-off, flight and passenger details. The operator relies on them, and wrong details can cause delays or extra charges under the operator's terms.
  • Live vehicle location and estimated arrival are a guide only. They depend on the driver's device, GPS and mobile coverage, and may be delayed or inaccurate.
  • Cancellations, changes and refunds are handled under the operator's policy.

5. Drivers

  • You use ChauffeurHQ Driver on behalf of the operator you drive for. Your working arrangement is between you and that operator, not Beewest.
  • Drive safely and obey the road rules. Don't handle your phone while driving except as the law allows, for example when it's mounted and used hands-free. Update job statuses and complete checks while safely stopped.
  • Only turn on live tracking for jobs you are doing, and turn it off when you're not. Location sharing is explained in our Privacy Policy.
  • Vehicle safety checks you submit must be honest and accurate. They may be relied on by the operator and regulators.
  • Only use passenger information to complete the job you've been assigned.

6. Operators

If you use ChauffeurHQ Office on behalf of an operator:

  • Your organisation's subscription, fees and service levels are covered by its separate agreement with Beewest. If that agreement conflicts with these terms, the agreement applies.
  • You're responsible for the information you enter, for who you give access to, and for having a lawful basis to collect and use your customers' and drivers' personal information, including telling them about it.
  • You're responsible for your own legal obligations as a transport operator, including licensing, record keeping, tax and regulatory reporting. ChauffeurHQ's reports are tools to help you, and you should check them before relying on them.
  • If you connect third-party services such as MYOB, your use of them is also subject to their terms.

7. Acceptable use

You must not:

  • use ChauffeurHQ for anything unlawful, fraudulent or harmful, or to make false or abusive bookings
  • harass, threaten or abuse drivers, passengers or operator staff
  • access accounts, data or parts of ChauffeurHQ you're not authorised to use, or try to get around its security
  • reverse engineer, copy, scrape or overload ChauffeurHQ, or interfere with how it works
  • use other people's personal information from ChauffeurHQ for any purpose other than the trip or job it was provided for

8. Availability and changes

We work to keep ChauffeurHQ reliable and secure, but we can't promise it will always be available or free of errors. It may sometimes be unavailable for maintenance, updates, or reasons outside our control such as outages at our hosting providers or mobile networks.

We may improve, change or remove features over time. Some updates may need you to install a newer version of the app.

We may update these terms. We'll change the date at the top, and for significant changes we'll take reasonable steps to let you know. If you keep using ChauffeurHQ after a change, you accept the updated terms.

9. Intellectual property

ChauffeurHQ, including its software, design and branding, is owned by Beewest or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the apps for their intended purpose while you have an account and follow these terms.

Operators own the business data they enter into ChauffeurHQ. You keep ownership of information you provide, and you allow us to use it to run ChauffeurHQ as described in our Privacy Policy.

10. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law, that can't lawfully be excluded.

11. Limitation of liability

To the extent permitted by law, and subject to section 10:

  • ChauffeurHQ is provided "as is". We don't make any promise beyond what these terms and the law say.
  • We are not responsible for the transport services operators provide, or for the acts or omissions of operators, drivers or passengers. This includes delays, missed pickups, fares, accidents, injury, and loss of or damage to property during a trip.
  • Where our liability for failing to meet a consumer guarantee can be limited, it is limited to supplying the services again, or paying the cost of having them supplied again.
  • We are not liable for any indirect or consequential loss, such as lost profits, revenue or business opportunities.

12. Ending your use

You can stop using ChauffeurHQ and delete your account at any time.

We or the operator may suspend or end your access if you break these terms, if it's needed to protect other users or ChauffeurHQ, or if the operator removes you from its account. Where it's reasonable to do so, we'll tell you first.

Sections that by their nature should continue after your access ends will continue, including intellectual property, consumer law and limitation of liability.

13. App stores

If you download ChauffeurHQ from Google Play or the Apple App Store, that store's terms also apply to your download.

If you use an iOS app:

  • These terms are between you and Beewest, not Apple. Beewest, not Apple, is responsible for the app and its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet any applicable warranty, you can tell Apple, and Apple may refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation for the app.
  • Beewest, not Apple, is responsible for handling any claims relating to the app, including product liability, failure to meet legal or regulatory requirements, consumer protection, privacy, and claims that the app infringes someone else's intellectual property.
  • You confirm you are not located in a country subject to a US Government embargo, and are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms, and may enforce them against you.

14. Governing law

These terms are governed by the laws of Western Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia.
